Criminal Case Law Update, Week Ending 1-28-11

The following criminal cases of note were decided this week: Washington State Law Washington State Supreme Court: State v. Irby: The Court affirmed the Court of Appeals? decision to reverse Mr. Irby?s convictions for first degree murder with aggravating circumstances, first degree felony murder, and first degree burglary. The Court concluded that the trial court violated Mr. Irby?s rights under both the federal and state constitutions to be present at trial by conducting a portion of the jury selection process by e-mail in Mr. Irby?s absence.
