What's the Supreme Court of California going to do with the new rules -- and when will they do it?

ADVERTISEMENTS

At the Lectern has some comments and links, but the bottom line is that in California we're all waiting to hear if the rules approved by the State Bar will be adopted "as is," or in part, or whatever.

I'm OK with them.  After some false starts and inexplicably delay, they're a reasonably good set of rules and comments.  For some reason, the idea was floated that advance waivers are unprecedented, but fortunately the State Bar realized that they were far from unprecedented and that California shouldn't take a major step backwards when the ABA, DC, NY and other important jurisdictions have long recognized the importance of advance waivers in some situations.  And, thankfully, California may drop its idiosyncratic conflicts rule (3-310) in favor of the ABA approach.  The decision to leave screening to the courts is acceptable as well.
