USA Justice Department Intelligently Shifts Stance on Gene Patents, Finding they Should Not Be Patentable

By Andis Kaulins

ADVERTISEMENTS

Andrew Pollack at the New York Times in Gene Patent Ruling Is Criticized by Industry refers to a major shift at the U.S. Justice Department (bravo!), now rejecting gene patents:
"[T]he Justice Department declared in a court filing late Friday that genes should not be eligible for patents because they are products of nature...."
In the article, those who support gene patents are quoted as describing their opponents in personally derogatory terms rather than sticking professionally to the legal issues, which are substantial, and which find the Justice Department in the right in shifting their legal stance on this important legal question.

Patents protect "inventions" by humans, whereas genes are inventions of the Almighty, thank you.

The idea that someone thinks they should be able to patent one of my or your genes is abhorrent and contrary to the logic of the law, which forbids the ownership of persons by others, and that, my fellow commentators, applies also to the parts out of which the human being is made.

No slaves are allowed by the U.S. Constitution.

Also no gene slaves.

Go make your money elsewhere.
