Killer dust: Judges rule on payouts
By Mark Ellis 27/10/2010
Families battling for compensation after loved ones died of an asbestos-related cancer took their cases to Britain’s highest court yesterday.
Seven judges at the Supreme Court will make a landmark ruling which could affect thousands of mesothelioma sufferers.
The three-day hearing will determine if long-suffering families can keep their hard-won payouts.
And for the first time the Law Lords will determine the legal limit for “low level” exposure - even though medically there is no minimum safe dose.
Mum-of-two Dianne Willmore, 49, died last year - the day after she won £240,000 compensation from Merseyside council for being exposed to asbestos at school in Huyton, Liverpool.
Her family’s solicitor Ruth Davies described the bid to claw the money back as “despicable”.
More than 2,000 die every year of asbestos-related cancers.
The Mirror’s Asbestos Timebomb campaign has revealed that 90% of schools contain asbestos.
