New California case: arbitrator must disclose defense practice

ADVERTISEMENTS

The arbitrator in an attorney-client fee dispute should have disclosed his defense-oriented practice, says the the California Court of Appeal in Benjamin, Weill & Mazer v. Kors.  I wonder how far this reasoning goes.  Almost all lawyers have a practice base with some economic foundation and almost all lawyer-arbitrators do their neutraling in a field where they have some expertise derived from practice.  Does that mean as an effective matter all lawyers who arbitrate must disclose and characterize that economic base in the arbitrator disclosures?  (Disclaimer: I know, worked with, and highly respect the particular lawyer in the matter.  In fact, I'd say he's held in the highest esteem in terms of integrity.)
