Jury Awards Pitcher $52K for Injury Suffered on Mound Deemed 'Too Big'

As the father of four boys who spends more time on youth baseball fields then any other adult in the United States, I was a bit dismayed to read about a 17-year-old pitcher in Prince George?s County, Md. who fractured his right arm while throwing a pitch in a baseball game -- and then somehow obtained a $52,703 jury verdict against the tournament organizer for building a mound that was "too big and too deep." The Maryland Injury Lawyer Blog reports (via Inter Alia) that the defendants in the case, Baseball Players Association, argued that the mound was not a problem, and that injuries to pitchers sometimes just happen. (See, e.g., Strasburg, Stephen). Despite the fact that the plaintiff incurred only $2,703 in medical bills, he asked the jury for an additional $50,000 and the jury took just one hour to award a verdict for the full $52,703. The defendants then filed a JNOV motion asking the judge to award them a judgment notwithstanding the verdict, but the case settled before any ruling on that motion for a confidential amount.
