Judge rules for - and against - changes in election statements

By Richard Binder

ADVERTISEMENTS

Orange County Superior Court Judge Kim Dunning in Santa Ana ruled Wednesday that revisions must be made to two political statements that will be printed in the Capistrano Unified School District's official election materials this fall.

Candidate John Alpay cannot say in his materials that school districts "cannot raise or lower taxes, or operate under deficit spending" or that Capistrano Unified had "hundreds of attorneys on retainer."  The Capistrano Unified Children First group, who is endorsing Alpay, cannot claim the Capistrano school board is backed by "interests hostile to public education" or that "trustees diverted more than $100,000 from classrooms to prevent this measure from getting to you."

Alpay can, however, legally state, "No one can accuse me of accepting support from the unions or any trial attorney organizations." For their part, Capistrano Unified Children First can  legally state, "No union was involved" in getting Measure H on the November ballot.

Unsurprisingly, both sides are claiming victory.  See the full story at OCRegister.com.
