: National Eminent Domain BlogEnbridge Fights On
By Alan Ackerman
The Illinois Commerce Commission effectively temporarily delayed the future permitting necessary for Enbridge to acquire property by eminent domain in DeWitt County. In all likelihood, the State Commerce Commission will come out and grant the utility condemnation authority, but the problems in Battle Creek are eye-opening.
Enbridge plans to build a new pipeline along the path of a former pipeline in western DeWitt County. It sought eminent domain status to facilitate access to the land, which it says it already owns. The Illinois Commerce Commission (ICC) denied that access, but said it could reapply in the future if the company encounters any real obstacles. The path crosses the land of many homeowners, many of whom protested before the ICC.
The company is building a pipeline to transmit crude from Canada to the Gulf Coast for processing. Enbridge spokesman Joseph Martucci, in an email Thursday, said 'the Southern Access Extension Pipeline has been delayed due to changes in the market and economy and the ongoing legal appeal of the ICC decision. I cannot give you a construction start date at this time.'
