Suit in O.C. claims adulterated olive oils being sold as extra-virgin

By Richard Binder

A suit filed in Orange County Superior Court this week claims that several retailers and producers of olive oil have been misleading Californians for years about the quality of the olive oil they've been selling and marking up the costs.

According to Daniel J. Callahan of Callahan & Blaine in Santa Ana, lead counsel for the plaintiffs, a recent report from the UC Davis Olive Center found that 69 percent of the imported oils sampled and one of 10 California-produced samples didn't meet international standards for extra-virgin olive oil. Callahan says in his statement, "Defendants ... charge a hefty premium for the product, when in fact the product does not meet that standard and is of inferior quality often adulterated with cheaper refined oils such as hazelnut oil or lesser olive oils."

The suit names Bertolli, Filippo Berio, and Colavita, among other olive oil brands, as well as chain stores like Kmart and Target.  The plaintiffs seek an injunction preventing the questionable oil from being distributed and may also request hundreds of millions of dollars in restitution.
