: Legal Pad | LAAppeals court stays med-marijuana store closings in Lake Forest
By Richard Binder
The 4th District Court of Appeal has granted a temporary stay allowing two medical marijuana dispensaries to remain open in the city of Lake Forest. Those dispensaries are Lake Forest Wellness Center and Collective and Independent Collective of Orange County.
Howard Nassiri in Anaheim represented the two dispensaries.
Orange County Superior Court Judge David Chaffee initially issued an injunction on May 28 that shut down the stores, ruling that they both violated Lake Forest's municipal code. The appeals court decision not only blocks that ruling but also a July 6 hearing during which Lake Forest planned to argue that the dispensaries were in contempt of court for refusing to close.
The appeals court is considering a similar case, and a ruling is expected in that one on July 19.
