: Legal Pad | LAJudge reconsiders stance on water restrictions
By Richard Binder
U.S. District Judge Oliver Wanger ruled yesterday that the current protections in place for salmon and steelhead that led to delta water pumping restrictions had a "draconian" effect on the water supply, and that the science didn't seem to support such measures.
This is a change of tune for Wanger, who invalidated permits permits on California's dams
and Delta pumps two years ago because they were too lenient to protect
endangered salmon.
Although water users in the Westlands district are claiming victory, the ruling affects only the biological study responsible for setting the conditions for the restrictions. Wanger says more information is needed. There will be a hearing today in Fresno to decide what adjustments to make, if any.
For more, including how this ruling affects a similar case involving the delta smelt, click these for details.
