: Ross' Employment Law BlogRLA election voting procedure is changed
The National Mediation Board (NMB) publishes its final rule in the Federal Register on Tuesday, providing that in Railway Labor Act (RLA) representation disputes, a majority of valid ballots cast will determine the craft or class representative.
The RLA applies to railways and airlines.
Previously, NMB required a majority of all eligible voters in a bargaining unit.
This rule aligns NMB practice with long-standing NLRB practice.
The rule goes into effect June 10, 2010.
