Misuse of employer?s computer results in suspension without pay for 90 days
Source: Newspaper report

Following an investigation by State Police, a tenured school teacher was arrested and charged with the Unauthorized Use of a Computer, a Class A misdemeanor. State Police investigators alleged that the teacher had used another person?s access code on a school computer, bypassing the District?s content filter system, and viewed pornographic materials. The teacher later pled guilty to the charge.

The teacher was then served with disciplinary charges pursuant to §3020-a of the Education Law for alleged ?conduct unbecoming a teacher.? The hearing officer, calling the teacher?s conduct ?inherently improper,? found the teacher guilty of conduct unbecoming a teacher and insubordination. The penalty imposed: suspension without pay for 90 calendar days.
