By ROGER ALFORD - Associated Press Writer FRANKFORT, Ky. -- One of the most recognizable names in Kentucky education circles won a victory Thursday in a legal fight of constitutional significance. The Kentucky Supreme Court ruled that Virginia Fox had been duly confirmed to an appointment on the Council on Postsecondary Education before being replaced in 2008 with another appointee by Gov. Steve Beshear. Justices left it up to a Franklin County judge to decide whether Fox, former chief executive of Kentucky Educational Television and a former state education secretary, should be restored to her position on the higher education council. Chief Justice John Minton Jr., writing for the majority, said the issue of reinstatement would be left to the trial court because it hadn't been fully argued.Full post as published by Kentucky Law Blog on April 28, 2010 (boomark / email).
