: Legal Pad | LAOC judge orders San Clemente to pay developer for zoning change
By Richard Binder
A group called Avenida San Juan Partnership purchased 2.85 acres of land in 1980 to subdivide into four single-family residential lots with an access road. Three years later, the partnership received city approval for their plans. According to news reports, the developer held off on construction because of high interest rates, during which time the plan approval expired. On reapplying, the Partnership was denied. In 1993 the city rezoned the land to only allow one property for 20 acres. The developer said it was never notified about this change.
Factor in a landslide and a couple of court decisions, and the city of San Clemente has been ordered to pay the developer about $1.3 million for changing the zoning.
