Privilege issue involving Blagojevich's former lawyer (or not)

ADVERTISEMENTS
This article is a little frustrating, because it raises an interesting issue but doesn't have all the facts a legal ethics wonk would want. In the upcoming trial of former Gov. Blagojevich, a lawyer will be called to testify and the issue of privilege seems contested and murky.  As far as I can tell, the lawyer was a government employee working for the Governor, in which case the identity of the client might have been Blagojevich personally or, perhaps, the office of the Governor, which was held by Blagojevich.  Can privilege be asserted, and, if so, by whom?
