Payment for time spent changing to and from uniform not required under the Fair Labor Standards Act
Bamonte v. Mesa, No. 08-16206 U.S. 9th Circuit Court of Appeals, March 25, 2010

City of Mesa, Arizona, police officers alleged that the city violated the Fair Labor Standards Act (FLSA) when it refused to compensate them for the time the officers spent the donning and doffing of their uniforms and accompanying gear.

The Circuit Court of Appeals, 9th Circuit, affirmed the district court?s granting the City?s motion for summary judgment. The court agreed that because the officers could perform this chore either at home or at their work site, neither the donning nor the doffing of police uniforms and equipment were compensable under the FLSA or the Portal-to-Portal Act.

The decision is posted on the Internet at: http://caselaw.lp.findlaw.com/data2/circs/9th/0816206p.pdf
