: Legal Pad | LANew lawsuits launched against the Catholic Church in San Diego
By Richard Binder
The San Diego diocese of the Roman Catholic Church is facing a unique lawsuit.
A Marine and ex-Navy sailor are saying their military service allows them to bypass legal hurdles and sue the diocese over the sexual abuse they say they experienced at the hands of priests in the 1970s. A judge accepts the argument and the cases will move to trial as early as this year.
The San Diego diocese argues that the legal window for these two men to sue has closed. The men counter that under federal law statutes of limitations don't apply to members of the military when they are in service.
Three years ago, the diocese agreed to pay $198 million to 144 victims, saying the accusations lodged against 42 priests were credible. Those settlements took place behind closed doors. This would mark the first time the public hears courtroom testimony from alleged abuse victims.
