The Pre-Trial Motion Judge Fine Ruled On

At his Defending People blog, attorney Mark Bennett has the motion that Judge Fine signed.  It's posted at, "Even in Texas, Death Penalty Still Constitutional."The motion that Judge fine did grant was the defendant?s Motion to Hold that Texas Code of Criminal Procedure Article 37.071 is Unconstitutionalis via Scribd.  The motion was one of a number of pre-trial motions that were filed in the case last year.  Judge Fine ruled on the motion and signed it yesterday.
