California Supreme Court Hears Gay Marriage Case

By Michael D. Bonasera, Esq.

ADVERTISEMENTS

In oral argument yesterday that took over 4 hours, “the California Supreme Court heard arguments in the most important same-sex marriage case since Massachusetts?s highest court allowed gay and lesbian couples to marry there more than four years ago.” This according to this story in the NYT which categorizes the principal question before the court as “what is the definition of marriage.”

It seems those against gay marriage are claiming that it will damage heterosexual marriages while proponents appear to be relying on the equal protection argument. While I don’t know which way this one will go, it sounds like the attorney’s for those opposed to gay marriage haven’t read Lawrence v. Texas, which overturned Bowers v. Hardwick… “Deeply rooted in our nations history and traditions” won’t work anymore folks.
