: It's (Barely) LegalCourt Faults Removal of Obese Child
By Glen Ashman
New York Law Journal
A couple's efforts to control their obese daughter's weight were made in good faith and did not justify a county agency's repeated removal of the girl from her parents' custody, a New York appeals court has ruled. The custody issue arose in 2003 when the Chemung County Department of Social Services filed petitions alleging the parents were neglecting their then-9-year-old daughter. According to Thursday's ruling, the girl's weight eventually exceeded 250 pounds and she had obesity-related health problems.
