Supreme Court to Take up Privacy Rights in Text Messages

By Jacqueline Lipton

ADVERTISEMENTS

Interesting story from today's Washington Post, reproduced in the Cleveland Plain Dealer.  The Supreme Court has agreed to hear a case about whether employees have a reasonable expectation of privacy for 4th Amendment purposes in communications sent on devices owned by their employers.  The case involved employer monitoring of personal text messages sent by employees on employer-issued pagers.  Employees were permitted to use the devices for personal messages, but it was not clear whether employers would monitor those communications, as the employer's policy for text messages was less clear than its policy on other forms of communication, like email messages.
