: Environmental Crimes BlogClean Water Act Revisions - S. 787 ? A Correction
By Walter James
The Baucus-Klobuchar-Boxer amendment to the Clean Water Restoration Act (S. 787), approved by the Senate Environment and Public Works Committee on June 18, 2009, proposes to restore the protections for waters of the United States protected prior to the Supreme Court?s decisions in 2001 (the SWANCC decision) and 2006 (the Rapanos decision).
In its essence, the Clean Water Restoration Act (S. 787) will remove the word ?navigable? from the definition of protected waters.
