: New York City Personal Injury LawyerDell Settles Sex Discrimination Case For $9.1 Million
By Oguz Ozdemir
Last year, Dell Computers made the Working Mothers 100 Best Companies list, but apparently not every female who worked for Dell agreed with that decision. Last October, two former female employees began fighting a class action lawsuit against Dell for sex discrimination with regard to salaries, promotions and career opportunities. The class action lawsuit would cover women who began working for Dell after February 1, 2003. The case was filed in the US District Court for the Western District of Texas, first by Jill Hubley and then Laura Guenther was added to the case as a plaintiff.
Hubley was seeking back pay, punitive damages, front pay and benefits for all members of the class and on July 17th, Dell agreed to settle the lawsuit for $9.1 million. The plaintiffs in the case received $4.5 million after lawyers fees were paid and $3.5 million was deposited into a fund to pay present female employees included in the lawsuit. This part of the fund is to be used to compensate the women whose present base salary at Dell does not meet standard equity margins after a thorough salary analysis for them is completed.
Hubley worked as a senior strategist in the learning and development division of human resources for two years between 2005 and 2007. A joint statement was released by both plaintiffs and Dell that a settlement had been reached in this case and any further pending legal actions would be dismissed without admittance of any wrongdoing by either party. A Dell spokesman announced that the company was pleased to have settled the issue. Dell also received recognition last year as Diversity's 25 Noteworthy Companies list.
