Program: Foreign Evidence - Collecting and Protecting It

By David Badertscher, PLL

ADVERTISEMENTS

ABA Criminal Justice Section Program

When: 6:30-8:30 p.m.
Thursday, September 17, 2009

Where: Clifford Chance US LLP
2001 K Street, NW
Washington, D.C. 20006

The need for and use of foreign evidence has grown significantly as US prosecutors increasingly target transnational crimes, including the FCPA, export controls and economic sanctions, money laundering and antitrust. Multinational investigations based on the extraterritorial jurisdiction of US criminal statutes require familiarity with international evidence gathering procedures, as well as local law restrictions such as data protection, domestic employment, national security and privacy laws.

We would be delighted if you would join us for a discussion on how the government gathers foreign evidence in multinational investigations, the means available to defense counsel to obtain evidence overseas, and the offensive and defensive use of local law protections.

Moderator: Ross Garber, Shipman & Goodwin LLP

Panelists:
Kathleen Hamann, Fraud Section, US Department of Justice
Alberto Arevalo, Office of International Affairs, US Securities & Exchange Commission
William Devaney, Venable LLP
