: Lenz BlogBrazil TRIPS Retaliation
By Karl-Friedrich Lenz
Brazil says they have the right to retaliate against continued violation of WTO obligations in the Cotton case against the United States to an amount of $800 million, including $340 million of “cross-retaliation” against American intellectual property rights.
There has been no case of actual cross-retaliation until now, even though it has been authorized before, for example in the U.S. Gambling case.
The option of Brazil retaliating by suspending TRIPS obligations has been discussed for a long time, I have blogged about it in October 2005. Now it might actually happen.
