Rumours and Revelations

By immlawyer

ADVERTISEMENTS

I've heard rumours that the entire Immigration and Refugee Board is meeting in Toronto in October of this year perhaps to be addressed by the Minister of Citizenship & Immigration.

If this is correct, it is undoubtedly to inaugurate the most sweeping changes since the implementation of the current legislative regime (the Immigration and Refugee Board). These will likely include a scenario where Tribunal Officers (formerly known as Refugee Protection Officers) will be making the initial determination of claims.

There is a problem however. Unlike Members of the Immigration and Refugee Board (who are arguably 'independent' from the Department), the Tribunal Officers are civil servants.

I doubt that the general public will perceive an issue with this. But can claimants be assured that their claims will be determined on the merits instead of implied or overt pressures by the Minister for the Tribunal Officers to determine claims in certain ways? Are civil servants capable of making independent decisions from the Department which issues their cheques?
