Posted on November 18, 2009Interesting article at the National Post ... an Ontario court case seems to indicate that sponsor's who's relatives default (receive social assistance/benefits) may not automatically be required to pay back the funds to the government. This despite the very clear Sponsorship Agreement which forms part of any family class sponsorship application requiring sponsors to be responsible for their relatives...

Julie Taub, an Ottawa immigration lawyer, suggests that immigration law be changed to grant only conditional status in Canada to the sponsored spouse. I'm not sure I agree. This could result in abuse and coercion as well - a method of control by the sponsor over the immigrant spouse...

The panel, which includes Leann King, a member of the Immigration Division, is a mock detention review proceeding using an actual transcript. Waren Creates - who has written a paper 'detained and terrified'- has brought up a good point regarding providing an affidavit or information about bonds persons and their relationship with the detainee, where the detainee would be residing after release, their particulars and details of assets, and the level of suasion they have over the detainee.

Was his actions precipitated because of a genuine risk on return to that country that wasn't recognized by Canada? Or was he simply in a fragile condition as a result of his immigration status and other circumstances? I don't know, but hope that a spirit of compassion is imbued with all of the stakeholders towards the 'clients'.
