The ?Injury? Part of a Personal Injury Claim; What is It?

By Norman Gregory Fernandez, Esq.

ADVERTISEMENTS

two cars involved in a crashI get calls from many persons who have been in a car, motorcycle, or other type of motor vehicle accident, who are not injured at all in the accident! I wonder to myself; what part of personal injury claim did they not understand.

Personal Injury Lawyers such as me exist to represent persons who are injured due to the negligence of another.

What constitutes injury in a personal injury case; the answer is not as cut and dry as you may think, which is why you will want to call me if you have suffered a personal injury in the State of California, or some other personal injury lawyer outside of the State of California.

Injuries can be physical harm to the body, or psychological injuries to the mind, or physical harm to property. Most traditional personal injury lawyers or attorneys focus on cases where there have been physical injuries to the body, or psychological injuries to the mind. Don?t get me wrong, we also handle damaged property aspects of personal injury cases, but the substantial part of personal injury cases, are where there is an actual physical or psychological injury to the person.

Most personal injury lawyers will not take cases where there is no injury to a person! Obviously if you have suffered a significant amount of property damage in a case you should still give us a call to see if we can help.

What is significant? Significant would be normally beyond the small claims limit of $7,000.00, in which case you may want to hire a lawyer to prosecute a property damage claim for you. If the claim is large enough, some personal injury lawyers may even take the case on contingency basis, such as a construction defect case which may have resulted in hundreds of thousands of dollars in damages.

Getting back on point; you should call a personal injury lawyer such as myself when you have been physically injured, psychologically injured, or have suffered significant property damage due to the negligence of others.

If you have been injured in the State of California and would like to get a free consultation from me regarding your case, you may call me at 800-816-1529, extension 1.
