By Richard Binder
A federal judge has tentatively ruled that Los Angeles Haven Hospice Inc. has standing to sue the U.S. Department of Health & Human Services over the validity of a regulation that governs how much a provider may receive in Medicare payments under a statutory cap.
Haven Hospice is fighting the department's demand that it repay $2.3 million in Medicare funds that the department claimed exceeded an aggregate annual provider cap for the fiscal year that ended on Oct. 31, 2006. The department has been demanding repayments since 2006.
