RE: Sentencing Contest Claims

Lee-
Let's not get into a pissing contest about who should oversee the claims that are pouring in re: the sentencing contest. Even if you think that I've got my hands full with the bankruptcy claims, I can handle this as well.

3% commish on whatever we get our hands on is 3%, and given that 50cent and that fellow Picower made substantial bets, we're not talking chopped liver here, and I'm in a much better position than you are to slow down the payouts, but still take the fees off the top.

My understanding is that FinAlternatives is about to launch a second contest that gives players the chance to bet on who will be named in the next round of indictments. This could be a treasure chest as far as claimant pools, and I'd be happy to share the oversight of that pool with you. Don't forget to bring your swimmies.

Speaking of treasures, I'm not at a liberty to admit or deny that it was Jamie Dimon that bought Mr. Merkin's art portfolio, but if the sale is netting almost $200 million, you can bet your last buck that I've already spoken to the Spitzers, and we're going to be sending a note to that kid Cuomo before lunch and explain to him that we're putting a claim on the proceeds.

On another note, I'm expecting to take possession of a Bentley within the next few weeks. I certainly don't need another car, so if you're interested, maybe we can work something out before we have to send it the auction block.

Last--I can easily explain why those that put money in before '95 aren't getting bupkus vs the payouts we've made to people that invested as recently as November.
I've been so busy negotiating the rights to my book, and what with being distracted by emailing back and forth with some of the 'victims', there are just so many hours in the day.

The fact is, and as any trustee would agree with, nobody says we have to treat this on a FIFO basis, and since Merrill is cooperating by not providing those early investors with documentation of checks and wire transfers made into BMIS accounts, we simply can't release the money they say they deposited.

Yes, this whole process might have moved faster if we brought in trained clerks, particularly the ones that worked on 17, but two of them have disappeared, and two others have been picked up by INS and are being sent back to Pakistan.
