Jurors Cause Increase In Mistrials Based Upon Prohibited Online Research

By David Badertscher, PLL

ADVERTISEMENTS

Today's New York Times features an article by John Schwartz: "As Jurors Turn to Web, Mistrials Are Popping Up."  It details the increasing trend of jurors to use modern technology such as Google, Twitter, cell phones, etc. to research issues before them on trial.  This practice of considering extra-judicial evidence is causing an increase in mistrials based upon the violation of the rules of evidence and judicial instructions.  The article is available at: http://www.nytimes.com/2009/03/18/us/18juries.html?scp=1&sq=twitter%20juror&st=cse
