: Kentucky Law BlogCRIMINAL: "Fen-phen lawyers appeal bond" HERALD LEADER
By Michael Stevens
Lawyers for Melbourne Mills Jr., William Gallion and Shirley Cunningham Jr. filed notice Friday with the federal court in Covington, saying that they plan to ask the U.S. Sixth Circuit Court of Appeals to look at their clients' bond amounts, some of the highest bonds ever set in the federal court in the Eastern District of Kentucky.
Mills had the lowest bond at $5 million. Gallion's bond was set at $52 million. Cunningham's bond was set at $45 million. The three also were given the option of posting real estate worth 110 percent of the cash bond amount. For example, Mills would have to post $5.5 million in real estate to be released.
U.S. District Judge William Bertelsman set the bail amounts after hearing several hours of testimony about the finances of all three defendants. Many of those bond hearings were closed, and many of the documents containing the men's financial information were sealed. It is unclear why the bond amounts were different or so high.
The three were indicted in June on conspiracy to commit wire fraud. All three have pleaded not guilty. They are accused of taking more than $65 million of a $200 million diet drug settlement for 440 clients. The Boone Circuit Court case was settled in 2001
