KLB COMMENT: As most know, there is some governmental ethics legislation also pending in the General Assembly. On-the-clock political activity is and should always be a concern, but will anyone ever address the accountability of a sitting judge or justice campaigning for re-election or election to another judicial office while currently sitting as an elected or appointed judge?
An incumbent/recumbent judge/justice has a distinct financial advantage with a fixed pay campaigning whereas the privately employed candidate will have to sacrifice time from his or her day to campaign for office.
This may not even be a problem and all elected/appointed judges put in their full work weeks at the office anyway. However, there is no procedure that I am aware of for accounting for their time on the bench.
