!--google_ad_section_start--pIn a Nebraska case, iArista Records v. Does 1-6/i, although the case is iex parte/i, the RIAA seems to be having a tough time following (a) the rules and (b) the Court's instructions.br /br /First their motion for discovery was denied because they'd failed to follow the local rules. The Court's order denying the motion appended a copy of the rules for the RIAA's lawyers to read.br /br /Then, after the Court allowed them discovery and established a schedule, the RIAA's failure to follow the schedule resulted in a Report and Recommendation from the Magistrate Judge recommending dismissal of the case, but "without prejudice".br /br /i[Ed. note. Why would the dismissal be "without prejudice"? It seems to me that if a case is dismissed for failure to follow the Court's orders, the dismissal should be "with prejudice". - R.B.]/ibr /br /a href="http://beckermanlegal.com/pdf/?file=/Lawyer_Copyright_Internet_Law/arista_does1-6Nebraska_080428OrderDenyMotDiscovery.pdf"Order denying motion for discovery/abra href="http://beckermanlegal.com/pdf/?file=/Lawyer_Copyright_Internet_Law/arista_does1-6Nebraska_080709OrderGrantDiscovery.pdf"Order granting motion for discovery/abra href="http://beckermanlegal.com/pdf/?file=/Lawyer_Copyright_Internet_Law/arista_does1-6Nebraska_081212OrderRecommendDismissal.pdf"Report and Recommendation recommending dismissal "without prejudice"/a!--google_ad_section_end--!--a href="http://www.ilrweb.com/viewILRPDF.asp?filename="*/a--!--p* Document published online at a href="http://ilrweb.com"Internet Law Regulation/a--!--pCommentary discussion:pa href=""/a--!--pcentera href=""img src="http://images.slashdot.org/sdit4n.png"/a/center--!--center pa href="http://www.digg.com"img src="http://digg.com/img/badges/91x17-digg-button.gif" width="91" height="17" alt="Digg!" //a/center--!--pcentera href="https://www.fsf.org/associate/riaa"img src="http://ohioelection2004.com/ImageHost/riaaexpertwitnessdefensefunddonate3.PNG" width=150/a/center--brbrfont size="-2"Keywords: lawyer digital copyright law online internet law legal download upload peer to peer p2p file sharing filesharing music movies indie independent label freeculture creative commons pop/rock artists riaa independent mp3 cd favorite songs intellectual property portable music player/font!--SPECIAL MESSAGE FOR LINDOR CASE ONLY--!--centerTo contribute to Marie Lindor's legal defense, see below.form action="https://www.paypal.com/cgi-bin/webscr" method="post"input type="hidden" name="cmd" value="_xclick"input type="hidden" name="business" value="wraymond@hotmail.com"input type="hidden" name="item_name" value="Marie Lindor legal Defense Fund (wraymond@hotmail.com)"input type="hidden" name="buyer_credit_promo_code" value=""input type="hidden" name="buyer_credit_product_category" value=""input type="hidden" name="buyer_credit_shipping_method" value=""input type="hidden" name="buyer_credit_user_address_change" value=""input type="hidden" name="no_shipping" value="0"input type="hidden" name="no_note" value="1"input type="hidden" name="currency_code" value="USD"input type="hidden" name="tax" value="0"input type="hidden" name="lc" value="US"input type="hidden" name="bn" value="PP-DonationsBF"input type="image" src="https://www.paypal.com/en_US/i/btn/btn_donate_LG.gif" border="0" name="submit" alt="Make payments with PayPal - it's fast, free and secure!"br /img alt="" border="0" src="https://www.paypal.com/en_US/i/scr/pixel.gif" width="1" height="1"/form/centerbrThe above donation button links to a PayPal account established by Marie Lindor's family for people who may wish to make financial contributions to Ms. Lindor's legal defense in a href="http://recordingindustryvspeople.blogspot.com/2007/01/index-of-litigation-documents.html#UMG_v_Lindor"UMG v.
