Schneller v. Cortes: Three Letters Sent to PA Officials RE: Electors

By Phil

ADVERTISEMENTS

James Schneller, pro se Plaintiff in Schneller v. Cortes, sent out three letters last week essentially requesting that top State officials consider Barack Obama’s eligibility prior to allowing Pennsylvania’s Electors to vote:

These are three letters I sent last week.  The Petition for writ of mandamus et al are docketed at 199 MM 2008 and were distributed to the Court on or about December 9th or 10th prior to filing of answers.

The three letters follow…

Re: Assistance with and Implementation of Investigation of candidate Mr. Barack Obama under Title 25 and Title 18
Dear Governor Rendell, Attorney General Corbett, the State Ethics Commission, and the Pennsylvania Legislature:
I am writing as an urgently concerned citizen.

The Attorney General is undeniably supported by the law and the facts at hand to immediately investigate, seek empanelment of a grand jury, and/or prosecute candidate Mr. Barack Obama, and any other suspected participant, for violations of Pennsylvania Law including Title 25 and Articles C and E of Title 18, if it is proven that the candidate’s affidavit submitted by him is false, and related acts.

As I have plead in my petition for mandamus to the Supreme Court at 199 MM 2008, the implications of Mr. Barack Obama’s heading our nation, while his standing as qualified remains in question, and while qualification, and the various questions as to sworn affidavits, go uninvestigated by any official, are antithetical to American ideals and to this State and Nation, which have so great a justice system, and so great a concern with loyalty.

If Commonwealth Officials have acted improperly, said law, and the Public Official and Employees Act would support an investigation as well.

Therefore I am humbly writing to demand that all possible effort be made to expeditiously accomplish said investigations, so that the citizens of our Commonwealth will not be openly slighted by a failure to implement the law and the federal Constitution, in regard to official  eligibility, and of conformance to the law by our apparent President elect.   The Commonwealth is fit and has authority to delay ascertainment and/or transmittal pending an investigation, especially one so important, and involving the underlying issues seen here.  The Commonwealth is fit and has authority to ascertain qualification under the United States Constitution Article 2 Section 1, and the federal authorities have avoided their authority in this question.  Other States have presently been requested to ascertain said qualifications of Mr. Barack Obama, and the underlying number of electors likely to be affected is substantial.

I have filed an application for injunction with my petition for mandamus, seeking, much like the petition, an order for abeyance of all activity regarding certification of the electors and transmittal of the copies of it, pending an urgent and prompt investigation to this effect by the Secretary of the Commonwealth.  To this application I would ask the approval and participation of you, especially Mr. Attorney General.  I request the Legislature’s and the appropriate committees’, and their chairpersons’, urgent promulgation of a bill to cause these investigations and abeyance, and any and all such action as will cause our State to take the proper stance in this matter, so as to assist in causing the office of President of the United States to remain as intended by the law.  Please use your discretion to not defer to the Supreme Court decision on my petition, where other avenues remain feasible, and so much is at stake.

I appreciate your understanding of these circumstances. Please contact me if I can be of assistance or further information.

Sincerely,

James D. Schneller

Re: REQUEST, MOTION, and PETITION to be Presented to the 56th College of Electors Scheduled to Convene in December of 2008

To The Members of the 56th Electoral College of Pennsylvania and to all officers, and nominees for positions of President, Vice President, Tellers, Secretaries, Parliamentarian, and Sergeants at Arms, of the College of Electors:

Pennsylvania, among our many wonderful features, has, through this College, played a fulcrum role in determining who is President of the United States, at numerous instances.

The College is requested and petitioned by citizen and patriot James D. Schneller to again, in this 56th College, exercise their authority and might, in order to cause certainty and fairness to what is, in this instance, a matter of national security and constitutional crisis that is threatening the electorate.

The Signor requests an introduction by the President or Vice President, and resolution by the College, and any other action deemed appropriate, as pertaining to the following, which is put forth in part as a proposed resolution by the College :

WHEREBY,
The Democratic candidate for President of the United States in this election has been repeatedly and continually alleged to have furthered his campaign, and entered into balloting, and election, despite strong allegations questioning his qualifications for that office under Article II Section 1 of the United States Constitution, and despite said candidate’s failure, and the failure of any official or State official, to defeat said claims, despite the express availability of inexpensive and conclusive proofs to that effect.
Numerous actions currently reside in State and Federal Courts of our nation which seek to bring these proofs or lack thereof to a just and constitutionally compliant resolution. There are chilling aspects of the controversy which bear on allegiance of the Commander in Chief, and conformance to the most basic of constitutional requirements, and which threaten to severely diminish the faith of the populace in government and in the people’s right to govern.
The pace of litigation in said cases is not able to keep abreast of the schedule for this College nor this College’s counterparts in each of the other 50 Colleges.

The College is required to meet today under law but is not precluded from postponing vote until a second meeting, so long as an ascertainment of the canvass is transmitted to the Joint Session of Congress in time for that proceeding on the canvass of the Electors. The College in fact would be justified in addressing the particulars of this controversy, as alternate to ascertainment, and as necessary to a resolution of the matter so as to implement the intent of Article II as amended, including by refusing to lodge any vote, objecting to the validity of the election or said candidate, remanding to the Secretary, and related actions.

Likewise, the Joint Session of Congress at their session, and at any session, has full right and authority to make any and all proceedings necessary to resolve said controversy.
The various parties in said litigation clearly intend to follow up requests such as the within request, with similar and equally valid requests to the Federal officials, who are officers or members of that proceeding, for a fair and just resolution, which is at present lacking in the entirety.

Because there are suits pending in 18 states, including most of the most populous states of our Nation, in this controversy, consideration of this matter is all the more warranted, where, in fact, litigation is pending in States encompassing a substantial portion if not a majority of the electors.

The College and all officials present have sworn allegiance to the Republic and the Electors have sworn that they will support, obey, and defend the Constitution of the United States and the Constitution of the Commonwealth of Pennsylvania, and that they will discharge their duties of this College with fidelity.

The College has a duty to perform their function beyond the letter of the statutes and has so performed in past occasions.
WHEREFORE, a resolution is requested:

That the 56th College of Electors is required to postpone vote until a second meeting, prior to transmittal of the ascertainment of canvass to the appropriate officers,

That the College is required to address the particulars of this controversy and to make findings so as to implement the intent of Article II as amended,

That the College is required to address the particulars of this controversy and to cause resolution in the interests of the Republic, and so refuses to lodge any vote, objects to the validity of the election or the inclusion of candidates on the ballot, and remands the certification of the vote of the electors of Pennsylvania to the Secretary of the Commonwealth, so that the Democratic Party candidate for President may be instructed to quickly show his proofs of qualification under Article II of the United States Constitution.

I thank the College of Electors for their attention to this request and any action deemed appropriate.

Sincerely,
James D. Schneller

Dear Secretary Cortes:

I, a concerned citizen and patriot of utmost virtue, request that the enclosed request, alternately designated as motion or petition, be delivered to the anticipated President and/or the Secretary of the 56th Electoral College, and the copies of it be distributed to the members of the College, in the interests of a full and fair College, and in the urgent interests of resolution of a severe crisis regarding the election in which they are about to proceed.

Thank you. Please contact me if I can be of any assistance or further information.

Sincerely,

James D. Schneller
