Under the Taylor Law, it is an Improper Practice to strike. Members face a two-day penalty for each day of striking, the union can be found in contempt and fined and the union could loose its check off. In the 2005 NYC Transit strike all of these penalties were imposed.
A November 10, 2008 New York Newsday article is reporting that the Transit union just had their dues check-off restored. That article is available here. The loss of dues deduction check off is a significant penalty for any union, as that would mean that union Stewards would have to individually collect dues.
