Schwab, dean of Cornell Law School and professor of law, discusses a new article he co-authored revealing that employment discrimination plaintiffs increasingly fare poorly in the federal courts. (The article, “Employment Discrimination Plaintiffs In Federal Court: From Bad To Worse?” can be obtained here.)
At the trial level, Schwab tells ACS the study shows that employers are going to win 80 percent of employment discrimination lawsuits. “So employment discrimination plaintiffs have a very tough row to hoe, as we say, in the federal courts,” says Schwab.
