Dorf Commentary Compares Student Speech Critical of Homosexuality to Funeral Protests Calling for the Death of American Servicemen

By Alliance Defense Fund

ADVERTISEMENTS

Today, Columbia law professor Michael C. Dorf has this commentary posted on Findlaw: "Can the government limit speech to protect a captive audience."

Dorf likens student speech that is critical of homosexuality to funeral protests that call for the death of American servicemen.  While there may be some similiarity in the controlling legal principles governing free speech, one has to wonder whether Prof. Dorf has an agenda in attempting to equate these two very different factual scenarios on the so-called "Day of Silence."

Whatever one may think of Prof. Dorf's commentary, the so-called "captive audience" theory is a very dangerous tool in the arsenal of "politically correct" activists both inside and outside of the judiciary.
