Prop. 8 supporters, who plan to appeal, argued that its title and summary wasn't neutral. The title and summary were changed by Atty. Gen. Jerry Brown after the California Supreme Court overturned the state ban on same-sex marriage.
Brown's original description was that the initiative amended the state Constitution "to provide that only marriage between a man and a woman is valid or recognized in California."
The new ballot summary reads that the initiative would "eliminate the right of same-sex couples to marry."
The judge ruled that the new ballot title and summary accurately summarizes the proposition, the AP reported.
