Appeals court rejects challenge to state medical marijuana law

By Jason Siegel

ADVERTISEMENTS

The challenge by San Bernardino and San Diego counties to California's medical marijuana laws was tossed by state appellate court judges in San Diego today, The Press-Enterprise reported (here).

The three judges rejected the counties' claim that the state's Medical Marijuana Program Act conflicted with the federal Controlled Substance Act and the the ID card provisions in the state law are invalid, according to the Press-Enterprise.

"The ruling is a stinging rebuke to the misguided attempt of a few rogue counties to undermine the will of California's voters and the well being of thousands of sick and dying patients," said a victorious ACLU attorney Adam Wolf in a press release.
