Miami Arrests Killer In Test Of "Stand Your Ground" Law

By David Badertscher, PLL

Source: Crime & Justice News

"More than five months after claiming self-defense in the fatal shooting of two unarmed men in a restaurant parking lot, Gabriel Mobley was arrested yesterday in Florida for murder, the Miami Herald reports. Prosecutors believe the case is a key test of Florida's 2005 so-called Stand Your Ground law, which loosened standards for shooting in self-defense. Mobley, 31, is accused of fatally shooting two friends.

''This arrest is very important because it sends a clear message. The Legislature passed the new Stand Your Ground law but it is not a free-for-all to execute people,'' said Miami-Dade State Attorney Katherine Fernandez Rundle. Under the state's previous self- defense law, a citizen had the duty to retreat before using deadly force to meet deadly force. Under the 2005 law, that duty is gone.'"
