Guest blog: More on Exxon v. Doe

One of the cases on yesterday?s conference was No. 07-81, Exxon v. Doe. The Solicitor General has recommended that cert. be denied in the case, which involves whether the collateral order doctrine permits an immediate appeal of a denial of a motion to dismiss on political question grounds, where the State Department has expressed concern the litigation could adversely impact U.S. interests abroad.
