because me+head cold+ court is sorta a bad combo. I say weird things on the record and I have a lower than usual threshold for prosecutorial nonsense. I got into a mini verbal sparring match with one of my prosecutors over a term of probation. My guy was charged with pirated DVD sales. They wanted normal sorta terms of probation (36 months, which I find too long for a first time offense, however prosecutors tend to think it is the norm) which included having no fake items in his possession. But they also wanted a stay away order from the location of arrest. I felt it was unnecessary, but normally I would have not thrown a fit. I think it was the way the prosecutor demanded it that got me going. He said it like my client was some sort of lunatic or danger to society...continue to full post
