COURTS: Judge tosses Richmond woman's lawsuit over arrest

By Michael Stevens

ADVERTISEMENTS

From the Herald Leader,

A Madison County woman's constitutional rights were not violated when she was mistakenly arrested by a Richmond police detective and jailed for four days, a federal judge has ruled.

The warrant and arrest was "supported by probable cause," U.S. District Judge Jennifer B. Coffman wrote in a May 22 order in the case of Debra L. Wren of Richmond.

Wren's case against the city of Richmond and Richmond Police Sgt. Rodney Richardson was scheduled for trial June 30 in federal court, but Coffman's order canceled the trial. The order granted summary judgment to the city and Richardson.

Wren's attorney, Brian Canupp of Paris, wrote in an e-mail that Wren has not decided whether she wants to "exercise any of her legal options including direct appeal to the 6th Circuit Court of Appeals."

Wren had named the city and Richardson as defendants in a 2006 lawsuit that alleged a violation of her Fourth Amendment right to be free from unreasonable arrest and her right under the 14th Amendment to due process of law.
