New Illinois Minimum TTD Rates Based on Increase in Minimum Wage

By Michael Progar

ADVERTISEMENTS
The Illinois minimum wage will increase annually over a four-year period, from the current rate of $6.50 per hour. The increases will be as follows:
  • July 1, 2007 - $7.50 per hour;
  • July 1, 2008 - $7.75 per hour;
  • July 1, 2009 - $8.00 per hour; and
  • July 1, 2010 - $8.25 per hour.
Section 8(b) of the Illinois Workers' Compensation Act provides that the minimum TTD rate shall be not less than the higher of the Federal minimum wage or the Illinois minimum wage, multiplied by 40 hours. The rate is increased by 10% for each spouse and child. Since the Illinois minimum wage is higher than the Federal minimum wage, the minimum TTD rates are as follows.

  • 0 children or spouse - $173.32
  • 1 - $199.32
  • 2 - $225.32
  • 3 - $251.32
  • 4+ - $260.00
For accidents occurring from July 1, 2007 through June 30, 2008 (minimum wage @ $7.50 per hour):
  • 0 children or spouse - $200.00
  • 1 - $230.00
  • 2 - $260.00
