The Northeast Mississippi Daily Journal reports, "Update: Berry's attorneys ask hearing on retardation claims." Attorneys for convicted murderer Earl Wesley Berry have asked the U.S. Supreme Court to hear his claims he is mentally retarded and, thus, cannot be put to death.The motion for rehearing was filed late Monday.Berry is scheduled to be executed by lethal injection at 6 p.m. Wednesday at Parchman penitentiary.And: Berry's appeal to the U.S. Supreme Court says the Mississippi Department of Corrections classified him as mentally retarded with an I.Q. of 72, which was confirmed by a qualified psychologist.His attorneys urged the court to hear the issue because they say the Mississippi Supreme Court repeatedly has refused to do so...continue to full post
