Submitting a false report
Dep?t of Correction v. Holder, OATH Index No. 2208/07

Administrative Law Judge John Spooner recommended termination for a correction officer who used excessive force against an inmate and submitted a false report about the incident. Surveillance video showed the employee striking the rear-handcuffed inmate in the back of the head while escorting him from his cell following an altercation with other officers. ALJ Spooner also found that the correction officer submitted a false report stating that he had merely pushed the inmate.
