By Ashby Jones
In the midst of a busy stretch of the current Supreme Court term, two justices recently found time to head back to school; one to preside over an Ivy League moot court competition, another to attend the spring football practice at a Big 12 school.
For starters, check out Liptak’s humorous assessment of the moot-court assignment, which he deemed “impossibly complex.”
Apparently, in the midst of all the moot-court fun, a bit of a jurisprudential disagreement broke out between the Chief Justice and 10th Circuit judge Michael McConnell. According to Liptak’s report, instead of arguing about which of two inconsistent Supreme Court decisions should apply, Judge McConnell said, the students might have bypassed the confusing caselaw and talked about justice in a broader sense. Chief Justice Roberts then suggested in his questions, “though perhaps only for effect,” that he wasn’t a big fan of allowing judges to make broad policy judgments.
According to the report, Thomas was a “guest coach” for the University of Nebraska football team on Saturday, and ran out on the field with the team prior to its game. He reportedly stayed on the sidelines during the scrimmage. Reportedly some 80,000 fans were in attendance.
Thomas’s wife Ginni is a Nebraska grad, and apparently Justice Thomas has become an avid supporter of all Huskers athletes — once reportedly telling team members “he bleeds Husker red.”
