: Legal Pad | LAAguirre appeals pension benefits ruling
By Jason Siegel
San Diego City Attorney Michael Aguirre filed an 111 page appeal in the city's pension benefits lawsuit, a press release announced Friday.
Last August, a Superior Court decision tossed the city's lawsuit.
"We return to court because justice has not been done, and quitting would mean a billion-dollar burden on San Diego taxpayers," Aguirre said in the release.
The suit aims to roll back the increased pension benefits given by the City Council to the San Diego City Employees Retirement System in 1996 and 2002, claiming that Superior Court Judge Jeffrey Barton erred in applying a one year statute of limitations to allegations of conflict-of-interest in the making of government contracts. Aguirre said that a law passed last year clarified that there was a four-year statute of limitations that applied to the pension suit, which was filed in 2005.
